Key Changes from IPC to BNS — What Lawyers Need to Know
The Bharatiya Nyaya Sanhita (BNS) 2023 replaced the 163-year-old Indian Penal Code on 1 July 2024.
While the BNS retains the core structure of criminal law, it introduces significant changes that every advocate, law student,
and legal professional must understand. Here is a summary of the most important changes:
New Offences Introduced
- Organized crime (Section 111) — First time codified; covers syndicate-based criminal activities with punishment up to life imprisonment or death
- Petty organized crime (Section 112) — Covers organised pickpocketing, snatching, trick theft etc.
- Terrorist act (Section 113) — Previously only in UAPA, now also in the general criminal code
- Mob lynching (Section 103(2)) — Murder by a group of 5+ on grounds of race, caste, community etc. — death penalty or life imprisonment
- Hit and run (Section 106(2)) — Causing death by rash/negligent driving and fleeing — up to 10 years imprisonment
- False promise to marry (Section 69) — Sexual intercourse by deceitful promise of marriage — up to 10 years
- Snatching (Section 304) — Distinct from theft, punishable with up to 3 years imprisonment
Offences Removed or Replaced
- Sedition (IPC 124A) — Replaced with "acts endangering sovereignty, unity and integrity of India" (BNS 152). The word "sedition" no longer exists in Indian criminal law
- Adultery (IPC 497) — Already struck down by Supreme Court in 2018 (Joseph Shine case); not included in BNS
- Attempt to commit suicide (IPC 309) — Removed as a criminal offence, consistent with Mental Healthcare Act 2017
