What are Court Fees?
Court fees are mandatory payments made to the government for filing cases in courts. In India, court fees are governed by the Court Fees Act, 1870 and respective State Court Fees Acts. The fee varies based on the nature of the suit, the court where it is filed, and the suit valuation. Court fees are typically paid through court fee stamps or through the court's e-payment system.
Types of Court Fees
Ad Valorem Fee
Calculated as a percentage of the suit value. Applied to money suits, property suits, etc.
Fixed Fee
A predetermined amount regardless of suit value. Applied to writ petitions, bail applications, etc.
Slab-based Fee
Different rates for different value ranges. Common in Delhi and some other states.
For money suits, court fee is calculated as a percentage of the claimed amount (ad valorem). The rate varies by state, typically ranging from 1% to 10% of the suit value.
Generally non-refundable. Partial refund may be available if a suit is withdrawn before hearing or settled through mediation, depending on state rules.
