What is Stamp Duty?
Stamp duty is a tax levied by state governments on property transactions and legal documents. It is governed by the Indian Stamp Act, 1899 and respective state stamp acts. The rate varies by state, type of transaction (sale, gift, lease, mortgage), property type, and in some states, the gender of the buyer. Stamp duty must be paid before or at the time of document execution for it to be legally valid and admissible as evidence in court.
Frequently Asked Questions
Yes, several states offer reduced stamp duty for women buyers. Delhi: 4% vs 6%, UP: 6% vs 7%, Haryana: 5% vs 7%, Rajasthan: 5% vs 6%, Maharashtra: 5% vs 6% (Mumbai). This is to encourage property ownership by women.
Stamp duty is a tax on the document/transaction itself. Registration charges are fees for registering the document at the Sub-Registrar office. Both are mandatory and separate payments.
Stamp duty is calculated on the higher of the agreement value (consideration) or the government-determined circle rate/ready reckoner rate. You cannot avoid stamp duty by understating the property value.
In India, stamp duty is typically paid by the buyer/purchaser. However, this can be negotiated between parties. For gift deeds, it may be paid by either party.
